Introduction

Welcome to the Learning Management System (LMS) operated by IMSTP Educational Services Pvt. Ltd. By registering for, accessing, or using this LMS, you agree to comply with these Terms and Conditions.

If you do not agree with any part of these Terms, you should discontinue using the LMS immediately.

Eligibility

The IMSTP Learning Management System is intended exclusively for registered students enrolled in IMSTP programmes, medical graduates and healthcare professionals participating in IMSTP training programmes, faculty members, and authorised administrators.

By registering on the LMS, users confirm that all information provided during registration is true, accurate, complete, and up to date. IMSTP reserves the right to verify submitted information and suspend or terminate access if information is false, misleading, or incomplete.

User Account

Each registered learner shall be provided with a unique user account and login credentials for accessing the LMS. Users are solely responsible for maintaining the confidentiality of their login credentials and shall not share, transfer, or permit use of their account by any other individual.

Any activity carried out through a user account shall be deemed to have been performed by the registered user. Users must immediately notify IMSTP of any unauthorised access, security breach, or suspected misuse.

IMSTP reserves the right to suspend or terminate any account involved in unauthorised use, fraudulent activity, or violation of these Terms and Conditions.

Intellectual Property

All educational content made available through the LMS, including video lectures, recorded classes, live session recordings, e-books, notes, presentations, clinical resources, question banks, mock examinations, practice materials, images, graphics, logos, course structures, assessments, and all other learning resources, shall remain the exclusive intellectual property of IMSTP Educational Services Pvt. Ltd. or its licensors.

Users are granted a limited, non-exclusive, non-transferable licence to access content solely for personal educational purposes. Users shall not download protected content unless expressly permitted by IMSTP, nor record lectures, screen record videos, reproduce, copy, modify, distribute, publish, upload, transmit, sell, sublicense, or commercially exploit any LMS content without prior written permission.

Unauthorised use, reproduction, or distribution of LMS content may result in immediate suspension or termination of access without refund and may also lead to legal action.

Course Access

Access to courses available on the LMS shall be granted only for the duration specified at the time of enrolment or as communicated by IMSTP. Upon expiry of the course validity period, access to course content may automatically cease without prior notice.

Any request for extension of course access shall be considered solely at the discretion of IMSTP and may be subject to additional fees and other conditions determined by the institution.

Live Classes

Students attending live online sessions are expected to maintain the highest standards of professionalism and academic discipline. Participants shall join using their registered identity, conduct themselves respectfully towards faculty and fellow learners, and avoid behaviour that disrupts the learning environment.

Students shall enable video whenever instructed by faculty or moderators for attendance verification, academic interaction, presentations, or other educational purposes. IMSTP reserves the right to remove participants or take disciplinary action for inappropriate, disruptive, offensive, or non-compliant conduct.

Recorded Sessions

Recorded lectures and educational resources made available through the LMS are provided exclusively for personal learning and academic development of enrolled students.

Users shall not download, reproduce, redistribute, upload, publish, transmit, or share any recorded lecture or educational material on social media, messaging applications, file-sharing services, websites, or any other digital platform without prior written permission from IMSTP Educational Services Pvt. Ltd.

Unauthorised recording, copying, or distribution of educational content may result in disciplinary action, suspension of LMS access, termination of enrolment, and legal proceedings.

Assessments and Mock Examinations

Assessments, quizzes, mock examinations, question banks, and other evaluation tools available through the LMS are intended solely for educational and self-assessment purposes.

Users must attempt assessments honestly and independently unless otherwise instructed. Any malpractice, impersonation, sharing of answers, unauthorised collaboration, or attempt to manipulate assessment results may lead to disciplinary action, cancellation of results, suspension, or termination of LMS access.

Certificates and Academic Records

Certificates, completion records, progress reports, and academic documents issued through or in connection with the LMS shall be based on the learner fulfilling applicable academic, attendance, assessment, payment, and programme requirements.

IMSTP reserves the right to withhold, correct, revoke, or reissue certificates or academic records if any error, misrepresentation, academic misconduct, non-payment, or violation of institutional policies is identified.

Payments

Access to paid programmes, courses, live sessions, recorded sessions, assessments, certificates, and other LMS resources shall be activated only after successful verification of the applicable payment.

All fees paid towards any programme shall be non-transferable unless otherwise approved in writing by IMSTP. In case of outstanding payment or failure to comply with an agreed payment schedule, IMSTP may suspend or restrict LMS access until all dues have been cleared.

Refund Policy

Refunds shall be governed by the refund policy applicable to the respective programme in which the learner is enrolled. Unless expressly stated otherwise in writing, fees paid towards digital educational content and LMS access shall be non-refundable.

Learners who have accessed course materials or partially completed any programme shall not be entitled to any refund. Administrative charges, registration fees, processing fees, and similar charges shall remain non-refundable under all circumstances.

Technical Requirements

Users are responsible for ensuring that they have the hardware, software, internet connectivity, and technical resources required to access and use the LMS effectively. This includes a stable internet connection, compatible browser, updated operating system, and functional audio/video equipment where required.

IMSTP shall not be responsible for interruption, delay, loss of access, or inability to use the LMS resulting from the user internet service, computer system, mobile device, software incompatibility, or any technical issue beyond the reasonable control of IMSTP.

LMS Availability

IMSTP shall make reasonable efforts to ensure that the LMS remains accessible and operational. However, uninterrupted availability cannot be guaranteed, and access may occasionally be suspended or restricted due to scheduled maintenance, software upgrades, technical failures, security enhancements, system improvements, force majeure events, or other circumstances beyond reasonable control.

IMSTP shall not be liable for inconvenience, loss of learning time, or damages arising from temporary interruptions, delays, or unavailability of the LMS.

Communications

By registering for and using the LMS, users consent to receive communications from IMSTP relating to academic programmes and LMS services. Such communications may include course updates, academic notifications, examination schedules, assignment reminders, payment confirmations, technical support messages, administrative announcements, and other relevant information.

These communications may be sent through email, SMS, WhatsApp, telephone calls, or LMS notifications. Users acknowledge that such communications form an essential part of IMSTP educational services.

Limitation of Liability

Educational resources, assessments, and services provided through the LMS are intended to support academic learning and professional development. IMSTP endeavours to provide accurate and relevant content but does not guarantee examination success, certification, employment, medical registration, visa approval, career progression, or any specific professional outcome.

IMSTP shall not be liable for direct, indirect, incidental, consequential, or special damages arising from use of or inability to use the LMS, including technical failures, internet disruptions, data loss resulting from user negligence, or circumstances beyond the reasonable control of IMSTP.

Account Suspension

IMSTP reserves the right to suspend, restrict, or permanently terminate a user access to the LMS without prior notice if the user violates these Terms and Conditions.

Grounds for suspension or termination include sharing login credentials, copyright infringement, academic misconduct, fraudulent activity, non-payment, misuse of LMS resources, unauthorised distribution of educational content, or any activity compromising the integrity, security, or reputation of the LMS.

Where an account is suspended or terminated due to a breach, the user shall not be entitled to any refund of fees paid.

Amendments

IMSTP reserves the right to modify, update, or revise these Terms and Conditions at any time to reflect changes in applicable laws, institutional policies, technological developments, or operational requirements.

Any revised Terms and Conditions shall become effective upon publication on the LMS or through any other official communication issued by IMSTP. Continued access to or use of the LMS after revisions are published shall constitute acceptance of the updated Terms and Conditions.

Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of India.

Any dispute, claim, or legal proceeding arising out of or relating to use of the LMS or these Terms and Conditions shall be subject to the exclusive jurisdiction of the competent courts located in Coimbatore, Tamil Nadu, India. Users agree to submit to the jurisdiction of these courts.
